Vincenta is an electronic celestial navigation aid designed to assist navigators in performing astronomical calculations and related computational functions used in celestial navigation.
Vincenta is intended solely as a supplementary computational aid and must not be relied upon as the sole or primary means of navigation.
Vincenta is not a substitute for proper navigational knowledge, prudent seamanship, professional judgement, or compliance with applicable maritime laws, regulations and accepted navigational practice.
Vincenta has not been evaluated, certified or approved as navigational equipment under the International Convention for the Safety of Life at Sea (SOLAS), by any flag state, classification society, maritime administration, or any other governmental or regulatory authority.
It is not approved for use as primary navigation equipment or as equipment required to satisfy any statutory carriage or safety requirement.
Vincenta performs mathematical and astronomical calculations and related computational functions only.
It does not determine whether observations are appropriate, assess environmental conditions, evaluate navigational hazards, detect collisions or grounding risks, or make navigational decisions on behalf of the user.
Although every reasonable effort has been made to ensure the correctness of the calculations performed by Vincenta, no software can be guaranteed to be free from defects, computational errors or unforeseen faults.
The accuracy of any calculated position depends upon many factors beyond the control of the software, including (but not limited to) the quality of celestial observations, the condition and adjustment of the sextant and associated equipment, the accuracy of the time source, environmental conditions, and the correctness of the information entered by the user.
Users are responsible for independently verifying all observations, calculations and navigational decisions using appropriate nautical charts, publications and, wherever practicable, alternative navigational methods.
Vincenta should always be used together with suitable navigational knowledge, properly maintained equipment and prudent seamanship.
The user remains solely responsible for the safe navigation of the vessel and for every navigational decision made using, or in conjunction with, Vincenta.
Vincenta is provided "as is" and "as available", without any representation, guarantee or warranty of any kind, whether express or implied, including (to the fullest extent permitted by applicable law) any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, reliability, non-infringement or uninterrupted availability.
To the fullest extent permitted by applicable law, Vincenta Ltd (Company Registration Number: 17407840, registered office at Suite A, 82 James Carter Road, Mildenhall, IP28 7DE), its directors, officers, employees, contractors, agents, licensors and distributors shall not be liable for any indirect, incidental, consequential, special or economic loss or damage arising out of or in connection with the installation, use, misuse, inability to use, or reliance upon Vincenta.
This includes (without limitation) loss of profits, loss of revenue, loss of data, business interruption, damage to property, interruption of a voyage, or any other navigational consequence.
Nothing in this Disclaimer excludes or limits any liability that cannot lawfully be excluded or limited under the laws of England and Wales or any other applicable law.
